IMPLEMENTATION AND APPLICATION OF THE PROGRAM «LENIENCY» IN THE UKRAINIAN LEGISLATION FOR ANTICOMPETITIVE CONCERTED ACTIONS

Abstract

Problem setting. Along with the use of severe sanctions as effective legal tools for fighting cartels, an effective mechanism for disclosing cartel agreements is the implementation of the program «leniency», that is, exemption from liability. The issue of developing a mechanism for implementing this program in the national legislation and its practical use to stimulate the disclosure of anticompetitive concerted actions and effective punishment of the perpetrators is problematic. Recent research and publications analysis. This issue, in particular in the context of the execution of coordinated actions in the countries of the European Union devoted a lot of attention of such scientists as: S. Valitov, Z. Borysenko, N. Trehubets, M. Barash, S. Melnyk, O. Kashtanov, H. Fyliuk, O. Bakalinska, O. Pletnova, and others. The issue of the release from liability of the members of cartels almost unexplored domestic legal science. However, some problematic aspects of the implementation concept of «leniency» at different times was covered by such practitioners as O. Kot, S. Shkliar, Ye. Bobonych, S. Shershun. O. Diakulych, etc. Paper objective. An article purpose is to analyse of the application liability for anticompetitive concerted actions and implementing regulation institute «leniency» in Ukraine. Paper main body. Among the most dangerous violations of competition legislation throughout the world are considered to be cartels. One of the most effective legal tools to fight and prevent the establishment of cartels is the use of severe sanctions to the violators. Along with its application analysis of law enforcement practices in the sphere of protection of competition allows to see what an effective legal tool for the investigation of cartels in Europe and the United States became a program of indulgence or liability (leniency program). The essence of the program is the full or partial exemption from the punishment of one or several members of the cartel, provided that they cooperate with the competition agencies during the period of investigation, and contribute to the cessation of infringements of the cartel. Conclusions of the research. The concept «liniency» has broad prospects for application in Ukraine under condition of improvement certain provisions of special legislation. According to Ukrainian antimonopoly legislation provides only full exemption from liability for anticompetitive concerted actions of economic entities. Therefore, it is advisable together with a full exemption from liability for the first applicant to provide a partial exemption from liability to other who have provided information or any other way contributed to the uncovering of the cartel. Also consider it expedient to guarantee to the participant who will help uncover the conspiracy ensuring total privacy and security protection. For its part, the person who helps reveal offense must adhere to certain conditions and really help the investigation by providing the necessary evidence. Short Abstract for an article Аbstract. The article is devoted to problems of application of responsibility and implementation of the exemption program from liability («leniency») in Ukrainian legislation, anticompetitive concerted actions. Along with the problem of complete exemption from liability, the actual possible implementation in Ukrainian legislation mechanism of partial exemption from liability to encourage the disclosure of anticompetitive concerted actions and effective punishment to the offenders.
