“Implementing the Constitution Fully and as a Whole”: Annulment Actions Brought Before the Constitutional Court by the Turkish Labour Party (1963 – 1971)

Abstract

Political parties are the paramount organisations that represent the interests of social classes and class fractions and mostly political parties dominate the legislative and oversighting processes in the parliaments. Constitutional courts, also defined as “negative legislators”, with the power of reviewing the acts of parliament on the ground of complying with the constitution, also plays an important role on the law and politics which are inseparable. This article aims to focus on the acts of parliaments that are brought before the Turkish Constitutional Court by the Turkish Labour Party (TLP), between 1962-1971. By doing that, we can identify the interests of social classes and class fractions which are represented by the TLP and how and by which arguments these interests are presented before the Court. Also, some observations will be made on the relation between law and politics from this standpoint.
