IMPROVING THE NORMS OF UKRAINE’S LEGISLATION IN THE FIELD OF AGRICULTURAL COMPLEX OF UKRAINE CONFIRMING CONTROL FUNCTIONS OF APPROPRIATE SUBJECTS

Abstract
Problem setting. The article deals with some problematic issues of control functions of the subjects of the agroindustrial complex of Ukraine on the basis of the analysis of current normative legal acts in order to improve the norms of Ukrainian legislation in this field. Target of research. The purpose of the study is on the basis of the analysis of theoretical foundations, legislative acts, to investigate the state of control functions of the subjects of the agroindustrial complex of Ukraine. Analysis of recent researches and publications. The following scientists analyze separate aspects of the question in their researches: V. B. Averyanov, O. M. Bandurka, Y. P. Bytyak, V. V. Galunko, T. O. Kolomiyets, L. I. Myskiv, I. A. Chernysh and others. Article’s main body. The legislation of Ukraine in the field of the agroindustrial complex includes the norms of administrative law contained in international acts, the Constitution of Ukraine, the laws of Ukraine and by-laws, other normative legal acts regulating the principles of organization and activities, functions, powers, competencies of subjects of regulation. In addition, it is important to take into account acts of official interpretation of the norms of administrative law adopted by the competent authorities, as well as acts explaining the practice of applying management acts; individual acts; acts of application of the norms of administrative law, for example, on consideration of a case concerning an administrative offense in the field of agroindustrial complex and application of measures of administrative responsibility. However, very often the powers of the controlling bodies are declarative, duplicate each other or enter into conflicts of interest. It should be borne in mind that any changes in the agrarian sector of Ukraine make significant changes not only in the work of the subjects of state control, the general state of the national economy, but also the national security of Ukraine as a whole. Moreover, among the threats to national interests and national security is the implementation of state bodies in the corporate and personal interests, which leads to violations of rights, freedoms and legitimate interests of citizens and business entities. Timely monitoring of the implementation of management decisions will promptly detect deviations in the implementation of these decisions and will enable the adoption of appropriate measures. Conclusions and prospects for the development. In order to ensure high-quality administrative and legal regulation of the sphere of agroindustrial complex, the administrative and legal doctrine should develop new comprehensive control measures which would be properly applied by the subjects of the agroindustrial complex, ensuring the optimal balance between the efficiency of the state agricultural policy and the observance of public interest.
