In dubio contra fiscum – kilka uwag na temat „barbarzyńskiej” zasady prawnej

Abstract
W relacjach państwo-podatnik fundamentalną rolę odgrywa zasada in dubio contra fiscum. Mimo, że została ona sformułowana po łacinie, jej korzenie nie sięgają starożytnego Rzymu. Zbudowano ją w epoce nowożytnej w oparciu o cytat z prac rzymskiego prawnika Modestyna. Pierwszym dokumentem prawnym, w którym pojawia się postulat sprzyjania podatnikom w postępowaniach sądowych jest list króla Ostrogotów Teodoryka Wielkiego do bliżej nieznanego Marcela, który na jego dworze piastował urząd advocatus fisci.
