«ІНСТИТУТ КОНТРАСИГНАТУРИ - ЯК СКЛАДОВА ПАРЛАМЕНТСЬКОГО КОНТРОЛЮ: ПОРІВНЯЛЬНО-ПРАВОВИЙ АНАЛІЗ»

Abstract
This article is devoted to the study of the origin of the possibilities of the countersignature institute in Ukraine as a component of parliamentary control in the system of "checks and balances", revealing the shortcomings of the counter-signature in the process of its implementation in our state, relying on the experience of the French and Czech republics. Within the framework of the presented material, the idea was proposed to introduce the term "countersignature" into the Constitution of Ukraine and its use within the framework of the implementation of parliamentary control. Comparing the mechanism of the institution of countersignature in Ukraine with the identical effect of this procedure in the Czech Republic and France, we come to the conclusion that in France and the Czech Republic, the acts subject to the procedure of contraction are closely monitored by the parliament of these republics by means of certain mechanisms. In Ukraine, parliamentarian, although they control the acts issued by the President of Ukraine, which are subject to contraction, but they exercise this control, can be said on their own initiative (according to the abovementioned Decrees of the Constitutional Court of Ukraine) because they do not have official authority under this. At the same time, there is no clear-cut principled interaction between the Government and the President regarding the institution of contradiction in the system of deterrence and counterbalance. At first glance, the range of issues that can influence the politics of the head of the Udong leader and other members of the Cabinet of Ministers of Ukraine is large. Unfortunately, the Prime Minister of Ukraine, having both the constitutional and other institutions, is fully implementing due to the lack of a minimum mechanism and procedure for applying the countersignature institution in practice
