INSTYTUCJA DOBROWOLNEGO ODSTĄPIENIA OD POPEŁNIENIA PRZESTĘPSTWA ORAZ CZYNNEGO ŻALU W ROSYJSKIM PRAWIE KARNYM

Abstract
This article concerns both institution of voluntary withdrawal from the offense and active re-pentance in Russian criminal law. This article analyzes the development of above mentioned insti-tutions in criminal codes which were in force on the territory of Russia from 60th of XX century. Described institutions have come through a long and interesting route of development from practi-cal absence in laws concerning criminal law to the complete regulation in Criminal Code of Rus-sian Federation enacted in 13 of June 1996. The most distinguishing feature of russian law in analyzed area is fact that division on volun-tary withdrawal from the offense which is used on the stage of preparation and an attempt to com-mit a crime and an active repentance used when the crime is already committed.
