Internal Market Freedoms and Democratic Principles of the European Union in the Judgments of the Court of Justice of the EU

Abstract

The article seeks to present selected judgments of the Court of Justice of the European Union (CJEU) concerning the freedoms of the internal market and the democratic principles embodied in the practice of the EU and its institutions. What the paper essentially investigates is the degree of consistency between the internal market freedoms and the democratic principles that seems to emerge from the judgments of the Luxembourg-based Court. The keystone that makes it possible to bring together these two sets of not always compatible values is the concept of fundamental rights.
