INTERNATIONAL LEGAL REGULATION OF THE INFORMATION SAFETY OF MINORS

Abstract

The complexity of the problem of ensuring the information safety of minors necessitates a study of the processes of international legal regulation in this sphere. As a result of summarizing the publications devoted to the study of international legal acts, the author of the article creates a classification of approaches to studying problems from the standpoint of the methodology of legal science. According to the dominant research, she identifies descriptive, hermeneutic, dynamic-historical, comparative legal, pragmatic and systemic approaches. The author’s choice involves the use of a systematic approach. As the main subjects of international legal regulation of the processes of ensuring information safety of minors, she identifies such international organizations, as the UN, UNESCO, UNICEF, the World Congress of Information Technologies, the Council of Europe and others. In connection with a significant array of documents issued by these organizations, the scientist proposes to introduce the author’s classification of international legal acts. The classification criteria are such elements, as character, time of action, legal force, form of consolidation of norms, subject of regulation and priority of subject-object relations, number of parties, degree of imperativeness, degree of formality, etc. The author tracks the trends of international legal regulation in the study sphere. The dynamics are manifested in the transition from the general principles of human rights of the child to the concretization of norms, from the regulation of communicative processes in a real environment to the communication of minors in virtuality. The scientist believes that the main trend in the international legal regulation of the information sphere is the orientation of content towards the goals of education and respect for human rights, as well as towards international cooperation.
