INTERPRETACJA UKŁADÓW ZBIOROWYCH PRACY JAKO SWOISTYCH ŹRÓDEŁ PRAWA – WYBRANE PROBLEMY

Abstract

The paper's task deals with the chosen problems we can meet with while interpreting specific sources of the labour law, which collective agreements are, and also to point how the practice of interpreting it by the highest court authorities in this scope is. The main thesis constructed therein is a need to bind courts and executives applying collective agreements with an intention of its authors, which are parties that entered into these collective agreements. Only the meaning granted to the text by parties intention can can result in the fact that we are talking about the law enacted by entities having a systemic ability, and are legitimated to enact such a law in the meaning given by them. Granting by courts to provisions of collective agreements the meaning diverging from intention of agreement's parties (intention from the moment of enacting) is creating certain new construct and is contrary to the monopoly of trade unions and employers for entering arrangements into. Thus an aim of this paper is a defence of the thesis constructed therein, especially with a reference to the current judicial decisions.
