INVESTIGATING SITUATIONS OF THE INITIAL STAGE OF INVESTIGATION OF ILLEGAL MINING OF MINERALS

Abstract
The article is devoted to the actual topic of investigation and problem situations in investigating environmental crimes. The legal basis of environmental policy laid down in the Constitution of Ukraine, which establishes the obligation of the State to ensure environmental safety, guarantees citizens the right to a safe and healthy environment. In modern conditions of society and state the rate of degradation of natural objects led to the violation of the ecosystem, the increase of morbidity, mortality and deterioration of the nation',s gene pool. The complex ecological situation largely caused by the constant increase in the number and high latency of environmental crimes. The level of latency of these crimes, unfortunately, very high. Meanwhile, socially dangerous consequences: disease and loss of life, pollution of large areas, mass destruction of animals and plants, risk of serious technological accidents or environmental disasters pose a real threat to national and environmental security of Ukraine. In this regard, priority in environmental activities is to improve law enforcement, forensic practitioners providing tools, techniques and methods specifically designed to meet the challenges of detecting, investigating environmental crimes and their prevention. Study of forensic investigation of the situation as a category has theoretical and practical importance. The theoretical value of developing of this problem in general is an objective need specifying the content and concept of the scientific category. The practical significance of test questions is that the definition of the content of investigative situations, their classification, analysis and evaluation enable objective justification choices of investigation techniques that are especially appropriate to the circumstances and objectives of the investigation at some stage.
