Abstract
The article scrutinizes the concept of the binding force of international law through the prism of the periodization of its history. Under different universal nomocracies in the history of civilization the cases of disproof of the binding force of international law are shown. Examples of such disproof are given. The approaches of a noted British jurist J. Austin to doubt the binding force of international law are referred to. The transformation of the Hegelian concept of international law as a “foreign law of the state” to the concept of primacy of national law, developed by the German international lawyer F. Zorn are shown. The “autolimitation of the state” concept of G. Jellinek is laid open. The views of the soviet jurist and diplomat A. Y. Vishynski, who substantiated the supremacy of the soviet law over international law are depicted. The role of the 1928 Kellog-Briand pact in the realization of the principal “interdiction of aggressive war” of international law is shown. Based on Art. 38 of the Statute of the UN International Court of Justice it is proved that the general legal principles, acknowledged by the civilized nations, compose the nature and principled of the binding force of international law.
