JURISPRUDENCE OF SOME INTERNATIONAL AND NATIONAL COURTS IN PROTECTION OF THE LEGAL CERTAINTY

Abstract
This study analyzes the jurisprudence of some international and national courts in protectionof the legal certainty of the person, which is a fundamental principle of the rule of law state and the protection of human rights. To protect human rights, the following conditions are essential: predictability of the law, accessibility of the law, non-retroactivity of the law and unitary interpretation of the law. The harmonization of these conditions is the prerequisite for quality legislation and its correct application, as it is essential for the respect of human rights.
