Justification of a court decision as a guarantee of its fairness and legality.

Abstract
In this work, a study was made of the problem of the application by national judicial authorities of the principles of fair trial in the light of their interpretation by the European Court of Human Rights. The duty of the Ukrainian courts to make informed and motivated verdicts was noted. There have been shortcomings in the practice of reviewing final decisions that have entered into force. It is pointed out that there are undemocratic normative legal constructions regarding appellate and cassational revision of individual cases.
