К вопросу об арестах судов для обеспечения морских требований в Украине

Abstract
В статье определены проблемы современной правоприменительной практики в сфере наложения арестов на морские суда в Украине. Отмечена необходимость формирования единой позиции судебных органов с целью устранения неоднозначного трактования правовых норм при аресте судов для обеспечения морского требования. Отмечено, что достаточно часто при решении вопроса об аресте судна в рамках рассмотрения гражданских дел суды Украины обращаются к нормам международного права. В настоящее время в Украине подлежат применению нормы, регулирующие порядок ареста судов, предусмотренный Международной конвенцией об унификации некоторых правил относительно наложения ареста на морские суда 1952 года, и главой 4 “Арест судов” Кодекса торгового мореплавания Украины.
