Криміналістична характеристика декларування недостовірної інформації

Abstract
У статті визначено структуру криміналістичної характеристики злочинів, передбачених ст.3661 КК України «Декларування недостовірної інформації». Указано, що криміналістична характеристика цього злочину являє собою сукупність взаємопов’язаних між собою значущих елементів, що мають значення для отримання доказової інформації, яка сприяє його розслідуванню. Зокрема, виділено й проаналізовано такі елементи: предмет злочину, час і обстановка вчинення злочину, способи вчинення злочину, сліди злочину й особа злочинця. The modern state has and performs a large number of functions aimed at ensuring the normal life of society and executing it as urgent and perspective inquiries. Implementation of such functions requires significant funds, which the state, not being a commercial enterprise in its traditional sense, is not able to earn on its own in sufficient quantity. At the same time, the state has a duty to provide pensions to pensioners, provide material assistance to people who are unable to earn enough for living by themselves, who are incapacitated and unable to work, to retain children left without parental care. Other functions of the state, such as the provision of external and internal security, justice, execution of sentences, also require constant substantial funding. Much of its provision is carried out precisely through the taxation of both: legal entities and individuals. Reducing tax revenues leads to underfunding of the functions entrusted to the state, and, accordingly, to reducing their quality and quantity. The problem of combating corruption is one of the most painful in modern Ukraine. Within the framework of the fight against corruption, the declaration of incomes of persons authorized to perform functions of the state or local self-government has a special place. In order to counteract the concealment of property and funds by such persons, on October 14, 2014, the Criminal Code of Ukraine introduced article 3661 "Declaration of False Information". As practice shows, the number of criminal proceedings initiated on grounds of declaring false information has a steady tendency to increase. In order to successfully investigate such crimes it is necessary to identify the elements of their criminalistic characteristics, which will be the basis for providing practical recommendations for investigation. The author points out that the criminalistic characteristics of this crime is a set of interconnected significant elements that are important for obtaining evidentiary information conducive to its investigation. In particular, the author identifies and analyzes the following elements: the subject of the crime, the time and circumstances of the crime, ways of committing the crime, traces of crime and the identity of the offender.
