LEGAL ASPECT OF PARTICIPATION OF MILITARY POWERS OF UKRAINE IN MEASURES DIRECTED ON FIGHT AGAINST TERRORISM IN PEACE-TIME

Abstract
The article is devoted to the analysis of the conditions and legal reason for participation of the Armed Forces of Ukraine in the antiterrorist operation (united forces operation) on the territory of Ukraine which can be occur in peacetime. The nature of the antiterrorist operation (united forces operation) and the reasons for its conduct on the territory of Ukraine are disclosed. Noted that according to the current legislation peacetime in Ukraine exists in the absence of armed aggression against Ukraine. The list of actions, provided by the legislation, that can be applied to Ukraine, which correspond to definition of Armed aggression is clarified. An accent on the fact that in accordance with the current legislation, armed aggression can only be external, as now aggression on the side of a neighboring state, is made. Any actions, including terrorist acts, seizure of territories, armed assault or any other actions of entities that are not public formation are not corresponded by the term “armed aggression against Ukraine” and may be qualified as a criminal offense. Also, the procedure for the transition of functioning of the national economy, state bodies, bodies of local self-government from peacetime to functioning in a special period and from a special period in peacetime is clarified. Attention is focused on matters of possible variants of transition functioning from peacetime to a special period. The emphasis is placed on the conditions for the emergence of a special period in the country. The question of the Armed Forces of Ukraine powers in the case of their involvement in the anti-terrorist operation (united forces operation) is researched. It’s specified, that if there is a special period in the conditions of armed aggression against Ukraine, the Armed Forces of Ukraine implement and execute their powers independently of other state bodies. The opinion that the personnel of the Armed Forces of Ukraine may be involved to perform tasks for a antiterrorist operation C that conducted in peacetime only by a decision of the Antiterrorist Center under the Security Service of Ukraine, and in the case of the involvement of the Armed Forces of Ukraine, their activities are coordinated by the Antiterrorist Center under the Security Service of Ukraine is argued. Also the main task of the armed forces during the antiterrorist operation (united forces operation) without the availability of armed aggression in peacetime is the protection of objects was established. In peacetime, the Armed Forces of Ukraine, except the protection of objects, do not take actions without the coordination of the Antiterrorist Center under the Security Service of Ukraine.
