LEGAL ASPECTS OF IMPLEMENTATION OF SOCIAL DIALOGUE SETTLING COLLECTIVE LABOR DISPUTES (CONFLICTS)

Abstract
The article is devoted to defining the legal aspects of the social dialogue in resolving collective labor disputes (conflicts) in general and at national level between the joint representative body of national representative trade unions at the national level and the Cabinet of Ministers of Ukraine with the definition of problems and solutions. Social dialogue is an unconditional prerequisite for economic and social development of Ukraine and plays a key role in resolving the economic, social and labor relations in socially heterogeneous society and is an integral part in solving collective labor disputes (conflicts) on the production, territorial, sectoral and national levels. The implementation of social dialogue between representatives of executive authorities, employers (enterprises, institutions and organizations all forms of property) and wage labor, ie workers in resolving collective labor disputes, is extremely important in Ukraine because of the long-term political and economic crisis and stay state virtually war. The absence of decisions on issues of employees leads to protests (rallies, demonstrations, picketing, overlapping roads etc.) that took place in 2015 virtually on the whole territory of Ukraine. These factors do not contribute to improving the investment climate, industrial development, stabilization of the banking and financial systems, improving social standards and safeguards in the state, but rather encourages society to radical actions, which have no place in a civilized democratic European state. A necessary condition for the proper implementation of social dialogue in resolving collective labor disputes (conflicts) is the proper regulatory support and practical steps of the parties to achieve social, economic and other compromises based on principles of equality, openness and the reality of actions in order to achieve positive results.
