LEGAL CONSEQUENCES OF VIOLATION OF CREDIT AGREEMENT: SEPARATE ASPECTS

Abstract
Separate aspects of legal consequences of violation of the credit agreement are covered in the article. Special attention is paid to such consequence in law as payment of a penalty and cancellation of the contract. Differentiation of such categories as «percents» and «penalty fee» is carried out. It is specified that the penalty fee is way of ensuring performance of obligations and cannot replace a payment for use of the credit in the form of percents. Legal positions of the Supreme Court of Ukraine on such cases are analyzed
