LEGAL FIELD OF UKRAINE IN THE RAIDING FIELD

Abstract
The article outlines approaches in order to highlight the essence of raids, to outline legal and regulatory sources for counteracting this phenomenon in Ukraine. The main schemes of “white”, “gray” and “black” raids are outlined in the very article. The problem of raid is, first of all, a threat to the development of Ukrainian entrepreneurship, and it is quiet logical that it has the economic basis for crime. It is clear that Ukrainian business can not overcome the wave of raider attacks on its own, and for this reason the state must create, in accordance with the challenges of time, a legal framework for counteracting this phenomenon. The purpose of the article is to highlight the ways for improvement of the legal in relation to raider attacks counteraction in Ukraine. The subject of consideration is regulatory and legal sources, which determine the content of state economic and legal policy on struggle against hostile takeovers of enterprises. Raiding is not only an economic and investment problem, it has turned into a political one. The reasons lie in the fact that these processes have reached the level of threat to the economic security of our state. First, it is reduced the investment attractiveness of the country for foreign investors, and second, businessmen do not want to register their companies in Ukraine that leads to the outflow of domestic investors abroad. That is why, corporate captures are one of the modern challenges to the Ukrainian legal system. Unfortunately, in our country this phenomenon has only negative nature: it tests the security of enterprises for strength, and the system of current legislation – for the effectiveness; it leads to corruption in the authorities; it is the reason for the outflow of investment and the growth of unemployment; it promotes the legal nihilism in the society, intensifies distrust of executive authorities, etc.
