LEGAL GUARANTEES OF ENTREPRENEURIAL FREEDOM: ACCENTUATION OF THE ISSUE

Abstract

Problem setting. Entrepreneurial freedom is determined to be a right for the choice of any type or form of entrepreneurship in any field, the choice of legislatively determined organizational and legal forms, and the creation of new entrepreneurship forms. Recent research and publications analysis. Scientists-economists pay attention to some directions of doing business by profit business entities as well as non-profit business entities, using a wide range of legal measures. O. M. V innyk, D. V . Zadykhailo, V. V . Laptev, V. K . Mamutov, V. M. Pashkov, O. P. Podtserkovnyi, V. A . U stymenko, and V. S. Shcherbyna, O. V . Shapovalova are the most noticeable among them. Nevertheless, issues of the research of legal measures of guaranteeing the entrepreneurial freedom have not been sufficiently examined. Paper objective. The paper objective is to research the legal measures of guaranteeing the entrepreneurial freedom as an important economic and legal phenomenon. Paper main body. A right for entrepreneurship is inherently non-alienated, and it contemplates providing everybody with equal opportunities for the realization of this right. Simultaneously, «freedom» should not be identified with «permissiveness». Guaranteeing the entrepreneurial freedom, the state determines scales of the admissible freedom due to the legal regulation. In order to create an optimal environment for all members of the market the state forms (within an applied state economic policy and on the basis of some leverages indicated in the article 10 of the Economic Code of Ukraine) business activity conditions being single and equal for everyone, which facilitate attaining the appropriate balance between private and public interests and strengthening a legal economic order in this field. Conclusions of the research. Practically, all directions of an economic policy accompanied by a range of legal measures being inherent to the directions are used as instruments of the realization of a right for entrepreneurship guaranteed by the state. The content of state legal guarantees on entrepreneurial freedom is integrative, synthetic, and aimed at a direct economic result. The article researches issues of entrepreneurial freedom, possible restrictions of such an activity, and its general principles. The author analyzes the constitutional and legal and economic and legal support of entrepreneurship. Consequences of the interference in the entrepreneurial freedom are considered. The author pays special attention to legal measures of guaranteeing the entrepreneurial freedom.
