LEGAL NATURE AND CONCEPT TERMS OF TOURIST ACTIVITY ARE ON CREATION AND REALIZATION OF TOURIST PRODUCT

Abstract
In the article the considered features of the legal adjusting of economic activity are in the field of tourism. Basic attention is spared to research of legal nature of tourist product as a base element of tour operating. Basic scientific conceptual looks are investigational to legal nature of tourist product taking into account the features of home legislation about tourism taking into account foreign experience of conduct of tourist business and him legal adjusting. The basic signs of tourism are considered as the social phenomenon, and also defects are inherent home tourist industry, in particular related to imperfection of concept vehicle of tourist sphere, distribution of the unorganized tourism, the terms of that complicate or do impossible the protection of consumers, and also questions are related to legitimation of participants of relations that arise up during realization of tourist activity in the process of grant of tourist services or creation of tourist product. The modern state of eurointegration processes that influence on development of tourist industry of Ukraine is considered. The signs of economic activity are educed and analysed as an exceptional activity tour operator on creation of tourist product in the context of contractual connections with other participants of relations that arise up during realization of tourist activity. On the basis of comparative analysis of modern doctrine approaches that are used in the investigated industry, taking into account foreign and home experience, educed defects in the field of the legal adjusting of tourist activity in Ukraine, certain reasons, that they were stipulated, and also mark ways of decision of the problem questions in particular related to the lacks of legal status of tour operator, as a basic subject of tourist activity. Conceptual basis is offered for the further working and improvement of tourist legislation of Ukraine, and also ways of decision of the questions, related to legal specialization of legislation that regulates a tourist sphere.
