LEGAL REGULATION OF LABOUR FOR MINORS UNDER THE LAW OF UKRAINE

Abstract

This article analyses to the peculiarities of labor relations involving minors. Minors in labor relations equal in rights to adults, and in the field of health and safety, working time, leave and certain other working conditions enjoy privileges established by law. Terms of minors in the production should be different from the conditions of adult workers. This is due to a physiological features of an organism of teenagers who just formed, and the absence of most of them, the occupation and profession. These circumstances and determined the difference of legal regulation of their work, although as a general rule for minors completely covered labor legislation and their rights regarding employment contract equal to the rights of adult workers. Legislator general rule does not allow for the employment of persons under 16 years. But there are some exceptions to this general rule. To prepare young people for productive work allowed the employment of students of secondary schools, vocational and secondary specialized educational institutions for light work not harmful to health and does not affect the learning process in their free time they reach the age of fourteen the consent of a parent or the person who replaces him. These provisions comply with international acts in this area. The current Labor Code establishes a number of prohibitions employment of persons under eighteen, prohibits the employment of persons under eighteen years of heavy work and jobs with hazardous or dangerous working conditions, and underground work; nor shall attract persons under eighteen years of lifting and moving things, the mass of which exceeds the limits for them; prohibited to engage employees under eighteen years of night, overtime work and work on weekends. Underage workers are a special category of workers different from other employees not only age but also the legal status, the presence of additional employment benefits and guarantees granted by the State in the performance of work, taking into account health and working conditions. The current labor legislation of Ukraine, regulations relating to child labor to protect young workers from the harmful effects on health and development.
