Legal regulation of recognition of foreign documents on education in the People’s Republic of China: national and international legal aspects

Abstract
Summary. In 2012 more than 400,000 people left China to study abroad, bringing the country to the top rank of international donor countries of international students. According to the Chinese government's plan adopted in 2010, the number of foreign students in China should reach 500,000 people by 2020. For the Chinese government, the attraction of foreign students is not only an instrument for raising the income of educational institutions (annually China receives from export of educational services up to 1 billion dollars), but also a mechanism for popularizing the country abroad, as well as improving the standards and quality of Chinese education and integration of the country into the international educational space. First of all, the issue of such large-scale academic mobility is related to the mutual recognition of foreign documents on education and scientific degrees. In the present research the author found that China's recognition of education documents is based on multilateral international treaties (the Regional Convention on the Recognition of Studies, Diplomas and Degrees in Higher Education in Asia and the Pacific of 1983, the Convention of the Asian and the Pacific on the Recognition of Higher Education Qualifications of 2011) and bilateral agreements (the relevant agreement was signed with Ukraine in 1998), as well as the legislation of the People's Republic of China (e.g., Education Law of the People's Republic of China). In addition, the processes of convergence of the European Higher Education Area and the Pacific Rim are taking place, as reflected in the drafting of the Global Declaration on the Recognition of Higher Education Qualifications. China not only approves the initiative to establish such a bridge between the regions, but also actively participates in it, being interested in integrating the educational spaces of countries along the “One Belt, One Road”.
