Legislation on Quarrying and Rehabilitation and Reclamation of Abandoned Quarries in the Area of West Azizia Libya

Abstract

— Libya has a variety of natural resources, and they are raw materials that are included in many strategic industries, but the method of extracting these materials greatly affected the surrounding environment of these quarries, whether during extraction or after the life of the quarries ended by leaving it neglected without rehabilitating and reclaiming the land and returning it as it was in the past. This failure is due to the authority responsible for the quarries and the failure to implement the laws and regulations that regulate the work of quarries. This study was carried out through field visits to the operating quarries and the abandoned quarries in the western region of Azizia city and to determine the damage caused by the operating quarries that release heavy dust that destroyed the vegetation cover of the neighboring area and the damages of the abandoned quarries that distorted the general landscape and the pastoral and agricultural environment in the region and also by reviewing the laws Organizing the work of quarries and identifying the weaknesses that contributed to the companies leaving the quarries neglected and abandoned without reclaiming them. The study showed that the first defect in determining the supervisory body that supervises the work of quarries and the application of laws, as well as the difference in the value of land rent and rehabilitation costs without paying a financial guarantee, obliges companies to rehabilitate and reclaim the land before recovering its guarantee. Therefore, we recommend the necessity of identifying a responsible body to supervise the quarries, in cooperation with the Ministry of Environment, to amend the laws of renting the exploited land and rehabilitating it, with the payment of a sufficient guarantee to guarantee the rehabilitation.
