LIABILITY FOR PRENATAL INJURIES IN THE CONTEXT OF THE PROTECTION OF THE RIGHTS OF CONCEIVED CHILDREN

Abstract
This article describes the issue of responsibility for injury suffered before the birth of a child in the context of the protection rights of conceived children. The right to life, as well as the right to health in relation to the child in the prenatal phase, and the right to prenatal tests done in the mother were indicated. The text shows the fundamental differences between the often misunderstood claims of wrongful birth, wrongful birth and wrongful life, with responsibility for prenatal injuries under Rule 446 Civil Code. The main issues related to the legal issue of the nasciturus were also highlighted<br/><br/>
