LOCAL SELF-GOVERNMENT AND GOVERNANCE IN GERMANY

Abstract

The article deals with the peculiarities of self-government in Germany and analyses the powers of regional and local authorities. It explores the constitutional and legal regulation of the model of local self-government in Germany. It determines the competences of local self-governments. The article goes on to examine the issues of the system of local financing, as well as the reorganization of democratic institutions. Traditionally, Germany has a politically and functionally “strong” type of local self-government and governance. The level of local self-government in Germany has already experienced serious reforms in its political as well as administrative structures. The experience of building and operating local self-government and governance in Germany can be considered as a model for implementing the principles of decentralization and subsidiary, taking into account all historical, geographical, ethnic, cultural and other factors in the development of German lands. The German federal system has a two-tier structure consisting of the federal level and lands. Constitutionally, the level of local self-government does not constitute an independent (third) level of the federal system, but according to the Basic Law of the Federal Republic of Germany, it is considered as an integral part at the land level. The long tradition of lands in Germany is the delegation of a large number of powers concerning implementing policies and performing administrative tasks to local self-governments. Thus, the segment of local governments of lands at a regional or local level in Germany is very narrow. Local government, which has a two-tier structure and consists of municipalities (Gemeinden, Städte) and counties (Landkreise), reflects this organizational logic of the interagency scheme of Germany and traditionally works according to the model of “duality of functions”, which covers both directly local government affairs and delegated government functions. Observations indicate that the role played by local governments in implementing policies in countries such as Germany is extremely important, which is directly linked to national governance, funding and public administration systems that standardise much of what local officials can do and how they can do it.
