METHODOLOGICAL BASIS IMPOSING RESTRICTIONS IN LAND USE, BURDENED LAND RIGHTS DURING LAND TENURE

Abstract
Done detailed analysis of the legal provision for the establishment, implementation and termination of encumbrances of land rights, restrictions in land use and found that the mechanism of regulation of this process needs to provide evidence-based proposals on its improvement, particularly in terms of restrictions on land use and their registration in the land, as an important means of influence on those rights in order to ensure rational land use and protection. Proved that the efficiency of administrative decisions when setting restrictions on land use purpose and usage of land is possible on the basis of land zoning, which is necessary to adopt the Law of Ukraine «On land zoning.» In addition, along with the current classification restrictions in land use classification proposed by types, namely, legal, environmental, ecological, technological, sanitation, urban and special. The result of scientific studies have proposed a model methodological process of land management actions on formation of territorial restrictions and encumbrances in land use, formed on the principles of state security, a combination of state and local interests, to achieve a balanced ratio of economic and environmental interests of society and ensure rational land use.
