Między wolnością a bezpieczeństwem. Analiza problematyki praw i wolności w ustawodawstwie polskim na przykładzie ustawy antyterrorystycznej

Abstract
Artykuł dotyczy kwestii regulowania prawem materii wolności jednostki oraz bezpieczeństwa państwa. Autor próbuje pokazać, że niemożliwym jest jednolite potraktowanie obu tych wartości w jednakowym stopniu, co wymusza przyjęcie jednej z nich jako dominującej w ewentualnych regulacjach ustawodawczych. Zdając sobie sprawę z tego, że prawo w głównej mierze reguluje kwestie związane z trwałością i funkcjonowaniem społeczeństwa, logicznym wydaje się dominacja aspektu bezpieczeństwa państwa w materii legislacyjnej. Autor pokazuje ten proces na podstawie tzw. ustawy antyterrorystycznej z czerwca 2016 r., stwierdzając jednocześnie, że przypadek polski nie jest odosobniony, lecz stanowi szerszą emanację zjawiska wkraczania państwa i prawa w sferę wolności jednostki
