MISAPPROPRIATE FAMILY BENEFITS AND THE FAMILY’S GOOD – ARTICLE 30.2.4 OF FAMILY BENEFITS ACT

Abstract
The decision granting certain family benefit using the attribute of sustainability and the protection of the principle of protection of vested rights. But it could be repealed and amended. An absolute condition for refund unduly family benefits is prior to recognize them as benefits unduly. The legal structure of benefits wrongly received at one end, to reconcile the requirements associated with the need to respect the principle of legality, on the other hand, must take into account the good of the family. An important function is performed by the authorities applying the law - in the course of proceedings they should abide by the law, including the Family Benefits Act. These authorities are reluctant to apply the principles enshrined in the Constitution, which is probably due to their excessive generally.<br/><br/>
