MODERN STATUS OF INFORMATION SAFETY OF MINORS AT LEGISLATIVE LEVEL

Abstract

The article is devoted to the analysis of the norms that are contained in the legislative acts of Ukraine and regulate the issues of information safety of minors. Given the large array of laws, the author suggests grouping them into three categories: 1. Acts regulating the basic norms of information law with a projection on the information security of minors. 2. Acts regulating the protection of the rights of minors, primarily in the information sphere, including administrative responsibility for violations of these rights. 3. The acts by which the norms of information security are established. As a result of the analysis, the researcher established quantitative and qualitative indicators of the representation of the material. He states that in Ukraine there is no separate special law regulating issues of ensuring information safety of minors. Most legislative acts represent two trends: 1. The inclusion of a special rule in the general norm without differentiation of elements. 2. Fragmentary inclusion in the text of certain provisions of the special rule. As the main shortcoming of the current legislation in the area under study, the author calls conservatism, the unpreparedness to take into account the specifics of globalization processes, information wars. He also notes that the attention of the legislator is concentrated on the press, television and radio, while the processes in the Internet sphere are not sufficiently regulated. The legislator, when formulating norms, takes little account of scientific research, especially in the field of social and age psychology. The texts of the laws of Ukraine to some extent take into account the real threats to the information safety of minors, but do not pay the necessary attention to potential (implicit) threats. The proposals developed by the researcher will help in the future to improve the existing legal norms in the field of ensuring information safety of minors.
