Multinacionalne (transnacionalne) kompanije kao subjekti međunarodnog javnog prava - Multinational (Transnational) Companies as Subjects of Public International Law

Abstract
The paper deals with internati onal legal status of multi nati onal (transnati onal) companies. The fi rst part gives an overview of this enti ti es and the specifi cs of their role in the modern world. In the second part, the author deals with the elements of internati onal legal personality of multi nati onal (transnati onal) companies. Such as internati onal legal regulati on of the positi on of these enti ti es, their specifi c rights and obligati ons under internati onal law, internati onal responsibility, process subjecti vity before certain internati onal judicial bodies and the special relationship (partnership) with internati onal organizati ons. It should be added that not only that internati onal law acknowledges their existence, but also multi nati onal companies themselves at least in part infl uence the development of that law. In the concluding remarks the author notes that multi nati onal (transnati onal) companies do not have all the elements of a full internati onal personality, the one that is inherent to states. However, even if not complete their personality is beyond doubt. Although between them, depending on the case, there are major diff erences, there is no dispute that, from the perspective of internati onal law, at least some multi nati onal companies have the legal capacity (the ability to be the holder of a larger or smaller circle of rights and obligati ons established by internati onal law), legal capacity (the ability to conclude internati onal agreements, create internati onal custom, etc.), tort capacity (the ability to provide for the legal bears responsibility for violati ng the norms of internati onal law), process capability (acti ve and passive legiti macy before some internati onal courts), etc. In all likelihood, along with the expected further strengthening of the economic, but also politi cal and every other power and role of the companies themselves, their internati onal personality will also become more and more developed, At one point this will require global (universal) agreement which would precisely defi ne rights, but, in parti cular, the duti es and responsibiliti es of these entities. Rad se bavi međunarodnopravnim položajem multinacionalnih (transnacionalnih) kompanija. U prvom delu dat je osvrt na te kompanije i specifi čnosti njihove uloge u savremenom svetu. U drugom delu rada autor se bavi elementi ma međunarodnopravnog subjekti viteta multi nacionalnih (transnacionalnih) kompanija. Takvim kao što su međunarodnopravna uređenost položaja ti h subjekata, njihova konkretna međunarodna prava, njihove međunarodnopravne obaveze, međunarodna odgovornost, procesni subjekti vitet kod određenih međunarodnih sudskih tela i poseban odnos (partnerstvo) sa međunarodnim organizacijama. Tome treba dodati da ne samo da međunarodno pravo uvažava njihovo postojanje, već i same multi nacionalne kompanije makar jednim delom uti ču na razvoj tog prava. U okviru zaključnih razmatranja autor konstatuje da multi nacionalne (transnacionalne) kompanije nemaju sve elemente punog međunarodnopravnog subjekti viteta, onog koji je svojstven državama. Ipak, čak i ako nije potpun njihov subjekti vitet je nesumnjiv. Mada među njima, zavisno od slučaja, postoje velike razlike, nema spora da, iz ugla međunarodnog prava, makar neke multi nacionalne kompanije imaju pravnu sposobnost (sposobnost da budu nosilac većeg ili manjeg kruga međunarodnim pravom utvrđenih prava i obaveza), poslovnu sposobnost (sposobnost zaključenja međunarodnih ugovora, stvaranja međunarodnopravnih običaja itd.), deliktnu sposobnost (sposobnost da se snosi predviđena pravna odgovornost zbog kršenja normi međunarodnog prava), procesnu sposobnost (akti vnu i pasivnu legiti maciju kod nekih međunarodnih sudova) itd. Sva je prilika da će se međunarodnopravni subjek- ti vitet multi nacionalnih kompanija tokom vremena sve više razvijati , uporedo sa očekivanim daljim jačanjem ekonomske, ali i politi čke i svake druge moći i uloge samih kompanija. To će zahtevati da on u jednom trenutku bude uređen globalnim (univerzalnim) ugovorom kojim bi što preciznije bili defi nisani prava, ali, posebno, i obaveze i odgovornost ovih subjekata.
