Non-discrimination and the Principle of Equal Treatment as Significant Constituent Parts of the Process of Shaping the Competitive Nature of Public Procurement Procedures

Abstract
This article concerns about the problem of non-discriminatory problems of European and Polish public procurement law. Awarding public contracts should take account of such principles as the principle of equal treatment, non-discrimination (and the related ban on discrimination), the principle of proportionality, and the principle of transparency. The implementation of the aforesaid principles makes it possible to achieve one of the fundamental goals of the procurement procedures, which is to remain competitive.<br/><br/>
