Non-Retroactive Challenges of the Criminal Law in the Procedure of International Criminal Court

Abstract

The principle of non-retroactivity rule is foundation of the law. So that this principle in the private law, public law and criminal law, even in international documents has a particular importance as a means of proving the truth. Failure to observe this principle in the Judicial procedure of civil, criminal, and international courts as well, is considered as the basis for judicial control and the annulment of acts arising from violation of the principle and If the judicial authorities neglect the principles are discussed in the process of investigation of litigations including civil, criminal, and international, higher judicial authorities that have higher supervision over the function and authority are obliged in order to violation of Judgments and a warrant functioning as a common principle. In addition to considering this principle of Iran’s internal rights and in the international aspect the rules governing of this principle has long emphasized the need to respect it.
