ON THE ISSUE OF CRITERIA FOR DETERMINING A METHOD OF LEGAL REGULATION FOR ENSURING AIR PROTECTION

Abstract
The article reveals the outcomes of the research of the sound theoretical basis for the applying of the imperative method of legal regulation as a way of the state to interfere in the relationships involving a public subject. Analysis of the cases, where discretionary method is inapplicable due to the absence or impossibility of determination of subject of the political dialog was conducted. Also, in context of the air protection regulations, effectiveness of the imperative method as an instrument of balancing social, economical and ecological interest was assessed. Author has also introduced the number of criteria that should be applied prior to giving preference to imperative method of legal regulation over another one.
