ON THE RIGHT TO JUST REMUNERATION

Abstract

Problem setting. In modern conditions of economic reforms and liberalization of state social policy the autonomy of employers in the regulation of employees’ remuneration significantly increases. However, the level of social guarantees significantly limited, because the employers underestimate their remuneration obligations towards the employees. In this light the issue of enforcement the rights to fair remuneration and its guarantee by the state become more current. Target of research. The aim of the article is to optimize the ways of ensuring the right to just remuneration. Analysis of recent research and publications. The legal principles of enforcement of the Constitution right on remuneration have been studied in the works of such scholars as: V. M. Bozhko, N. B. Bolotin, Ju. M. Veres, O. V. Hayevyi, N. D. Hetmantsev, S. Ju. Holovin, O. O. Ershov, M. I. Kuchma, L. I. Lazor, R. Z. Livshits, M. V. Lushnikov, A. Ju. Pasherstnyk, S. M. Prylypko, O. I. Protsevskyy, V. A. Radionova-Vodyanytska, N. M. Salikov, N. M. Khutoriyan, E. B. Khokhlov, G. I. Chanyshev, O. M. Yaroshenko and others. Article’s main body. The basis of organization of the remuneration in Ukraine is the tariff system that is the set of standards regulating and differentiating the employees’ salary, depending on the complexity of the work (employees’ skills), on the characteristics and importance of certain types of productions, on the categories of employees involved in production process and on the working conditions. Conclusions and prospects for the development. The Cabinet of Ministers should develop and adopt unified tariff scale of categories and coefficients for employees to streamline the remuneration of all employees and to create the mechanism of optimal inter-industry and inter-jobs relations in the remuneration field. Such tariff scale should be extended to all employers regardless of ownership form and organizational-legal form. It will help to ensure the realization of the right to just remuneration by the differentiating of salary depending on the complexity of work, on the characteristics and importance of certain types of productions, on the categories of employees and on the working conditions.
