ORGANIZATION OF THE JUDICIAL AUTHORITY IN WESTERN UKRAINE IN THE COMPOSITION OF SECOND COMMONWEALTH OF POLAND (1919–1939)

Abstract
Article analyzes the socio-political background and gives a theoretical substantiation of the organization of the judiciary in Western Ukraine in the Second Commonwealth of Poland (1919–1939). It is noted that in the Second Commonwealth of Poland there were two systems of courts – general and special. It was discovered that the proceedings in them were proclaimed open (vowel), only in exceptional cases it could be secret. Other important principles of the judiciary include: independence of judges; their appointment; exclusive jurisdiction of courts in restoring justice; exclusion from the competence of courts of law to determine the constitutionality of normative acts; hierarchical institution of judicial bodies. Considerable attention is paid to the characteristic of the organization of the judiciary in Western Ukraine in the Second Commonwealth of Poland (1919–1939).
