Organizational and Legal Guarantees of Realization of Citizens’ Rights in the Sphere of Executive Authority

Abstract
The article considers the types of guarantees of realization the rights of man and citizen. The main attention is focused on the organizational and legal guarantees of realization of citizens’ rights in the sphere of Executive authority. Realization of citizens’ rights provides its real implementation in life, and legal guaran- tees are considered as provided by law of the conditions and means under which the legisla- tor connects a real opportunity and maximizes the realization of human rights. A legal guar- antee of realization of citizens’ rights in the sphere of Executive authority is a type of legal guarantees. Organizational guarantees of citizens’ rights are seen not only as the activity of the Executive authorities and other state structures, but also as creation, its existence which guar- antees the possibility to implement the constitutional rights and freedoms of citizens in the sphere of Executive authority. Legal guarantee for the realization of citizens’ rights is not only organizational forms, but also defined by Executive authorities powers and other state structures and precise perform- ance of officials regulations and legal acts ensuring the implementation of an act by which the procedure of mutual relations of citizens with the Executive authorities on realization of rights may be set. There is considered the close relationship between organizational and legal guarantees by which the legal norms of types of guarantees are fixed but also regulated organizational form of implementation. On the basis of the conducted analysis, the author concluded on the necessity of improve- ment of organizational and legal mechanism of guaranteeing of citizens’ rights in the sphere of Executive authority.
