ОСНОВНІ ЗАВДАННЯ ДЕРЖАВИ ЩОДО РЕАЛІЗАЦІЇ ПРАВОЗАХИСНОЇ ФУНКЦІЇ

Abstract
У статті крізь призму функціонального призначення правоохоронних органів України розглянуто основні завдання держави щодо реалізації правозахисної функції. Проаналізувавши низку нормативно-правових актів та думок науковців у даному напрямку, зроблено висновок про необхідність чіткого розмежування мети та основних завдань держави щодо реалізації правозахисної функції. The question of the main tasks of the state in implementing the human rights protection function, despite the importance of their solution, is clearly not resolved by law. The article attempts to consider this issue through the prism of the functional purpose of law enforcement agencies of Ukraine. Due to the fact that in its content the human rights function of the state is versatile, multifaceted, for a more detailed study of the essence, significance for society, the place of protection of rights, people in the legal life are obvious need to clarify the main tasks that it performs. Proceeding from the content of the basic law of our state, we conclude that the main object of human rights protection of the state is a person - her life and health, honor and dignity, inviolability and security. Due to the implementation of this provision an appropriate social effect is achieved, social and public interests are provided. This thesis is confirmed by the international processes taking place in the modern world and have a pronounced anthropocentric nature. In turn, in order to protect the rights and freedoms, human security in the state, the constitutional order, sovereignty and territorial integrity, and the economic and information security of the state as a whole must be ensured. These provisions should be considered as the main guideline in clarifying the main tasks of the state in the implementation of human rights functions, since they clearly identify those values that should be the basis for the existence of a person. Having analyzed a number of normative legal acts and opinions of scientists in this direction, it was concluded that the obligatory condition for effective functioning of law enforcement bodies is the clear regulation of their activities, as well as the need for a clear distinction between the purpose and the main tasks of the state in implementing the human rights protection function.
