ОСОБЛИВОСТІ НОРМОТВОРЧОГО ПРОВАДЖЕННЯ У ПУБЛІЧНІЙ СФЕРІ

Abstract
Досліджено як співвідносяться поняття «нормотворчість», «нормотворчий процес» та «нормотворче провадження» у публічній сфері, за результатами якого дано визначення поняття нормотворчого провадження, а також розглянуто різні наукові підходи до класифікації стадій нормотворчого провадження і на основі їхнього аналізу запропоновано власні стадії, серед яких: підготовка, обговорення та розгляд проекту нормативно-правового акта, прийняття, реєстрація, опублікування нормативно-правового акта та надання йому чинності. The rule-making activity in the public sphere is normally a rather complex and long process. The regulation of the corresponding procedure, imposing clear procedural limits serve as an important guarantee of the appropriateness and legality of subordinate acts, issued in the sphere of the functioning of the public administration bodies. Despite some complication of the administrative proceedings, which at first sight, their detailed administrative-legal regulation allegedly entails, the latter only contributes to the efficiency of managerial decisions. By executing certain established stages and steps, which are carried out in a clear sequence, the subject of rule-making achieves its main goal after all, the adoption of a qualitative and impeccable normative act from a legal point of view. In the legal literature the rule-making process is regarded as a process that represents a definite turn of the stages. Meanwhile, the stage appears as a form defined in time, which contains the corresponding functional content, i.e., those requirements that are imposed on the participants of the process and their actions in order to achieve the substantive law result, provided by the legal norm. In the scientific literature there are various views on which stages of the rule-making process should be distinguished. There is a large number of normative legal acts that regulate separate stages, steps of rule-making proceeding. The quality of legal regulation of social relations in the country, the protection of interests, rights and freedom of citizens entirely depends on the quality of subordinate normative legal acts. Therefore, on the basis of the analysis of existing scientific approaches, as well as the current legislation of Ukraine and the generalization of the practice of its implementation, it is necessary to determine the essence and features of rule-making proceeding.
