Abstract
The article is devoted to the issue of compensation for moral damage in violation of consumer rights protection. It was found that the legal definition of the term ‘moral harm’ is not contained in any normative-legal act. In accordance with paragraph 3 of the Resolution of the Plenum of the Supreme Court of Ukraine “On judicial practice in cases of compensation for moral (non-pecuniary) harm”, moral hazard should be understood as loss of non-property nature as a result of moral or physical suffering or other negative phenomena caused to an individual or legal person by unlawful actions or inactivity; moral harm may consist, in particular, in the degradation of honor, dignity, prestige or business reputation, moral feelings due to damage to health, violation of property rights (including intellectual property), rights granted to consumers, other civil rights, in connection with the illegal stay under investigation and the court, in violation of normal life connections because of the impossibility of prolonging active social life, violation of relations with others, with other negative consequences. The paper analyzes modern legislation in the field of moral damage in violation of consumer rights and jurisprudence, which has developed at this time in Ukraine. It should be noted that the special laws regulating the protection of consumer rights in Ukraine, namely the Law of Ukraine “On Consumer Rights Protection” and the Law of Ukraine “On Responsibility for Damage Caused by Defects in Products”, do not contain any mechanism for the compensation of moral damage. An analysis of judicial practice shows that in cases before the courts of the first or second instance violation of any contractual obligations may be grounds for compensation for moral harm. However, the higher courts came to the opposite conclusion: in the case where compensation for moral damage is not provided for by the contract concluded by the parties, and there is no law providing for compensation for moral damage in the existing legal relations, the claim for satisfaction of moral damage should be refused. The work proposes ways of solving existing problems, including the way of improving the provisions of the legislation.
