ПОНЯТТЯ І ОСНОВНІ ОЗНАКИ «БЕЗПОСЕРЕДНЬОГО ЗДІЙСНЕННЯ ВЛАДИ НАРОДОМ»

Abstract
У статті досліджується нормативне закріплення поняття «безпосереднє здійснення влади народом», наукові підходи до визначення даного терміну, аналізуються точки зору різних авторів на дану проблематику. В результаті аналізу, узагальнюються наукові підходи до визначення досліджуваного поняття, виокремлюються його ознаки, на підставі чого пропонується авторське визначення даного терміну. In article standard fixing of the concept «direct implementation of the power by the people», scientific approaches to determination of this term is researched, the various authors points of view on this problematics are analyzed. So, in particular, it is noted that the regulatory base of Ukraine, the international regulatory legal acts don't give definition of the term «direct implementation of the power by the people». For this reason among the topical issues connected with direct implementation of the power of the people one of the key question is a question of provision of clear definition to this concept. On the basis of the detailed analysis of theoretical achievements of domestic and foreign scientists, taking into account provisions of regulatory legal acts in article the following characteristics of direct implementation of the power by the people are distinguished. Summing up told, it is concluded that the concept of category «direct implementation of the power by the people» should be defined as a separate type of the public power, has dominant character in relation to other types of the public power and has complex, absolute legitimate character, is carried out constantly and continuously and means the right and real ability of the people to realize the power belonging to it through implementation of constituent, law-making, initiative, control, protective activity.
