PRACTICE OF APPLICATION OF THE LEGISLATION ON REDEMPTION AND REMOVAL OF CONVICTION

Abstract
The problem of improper and negligent application of legislation on repayment and removal of criminal record is considered, which is extremely urgent and requires an early decision. Various scientific studies of modern Ukrainian scientists on the essence of the criminal record and the procedure for its redemption and withdrawal are analyzed. The generally established concept of conviction and its characteristic features have been clarified. It is established that courts, when applying legislation on the repayment or removal of a criminal record, allow a number of significant errors that have a significant impact on the fate of citizens. It is proposed to adopt and implement a memo for professional judges, which clearly prescribe what judges should do in those situations where they need to determine whether a person is convicted or not.
