PREPARATION FOR JUDICIAL DEBATES OF THE CASES REGARDING THE CONTESTATION OF THE NOTARIAL BODY REFUSAL TO FULFILL NOTARIAL ACTS AND THE CASES ON THE VERIFICATION OF THE LEGALITY OF FULFILLED NOTARIAL ACTS

Abstract
In this scientific and practical article the author conducted a study of main aspects of preparation of cases about appealing in the Administrative Court against notarial actions or refusal to make the same for judicial proceedings. The author made an analysis of the current civil procedural legislation of the Republic of Moldova on the preparation of civil cases for judicial proceedings. He also made an analysis of legal norms on the organization of notarial activity in order to identify common patterns and features of preparation of cases under the claims on the performed notarial actions or on the refusal to make the same. We have identified the most important aspects of preparing for judicial proceedings of cases of this type, taking into account the determination at this stage of the subject of proof, necessary evidence, the composition of the persons taking part in these cases etc. We also proposed recommendations on how to improve legislation of the notariat and civil court procedure.
