PRESUMPTION FOR PATERNITY WITH DECLARED ABSENCE OF THE MOTHER’S HUSBAND

Abstract

The presumptions for paternity are not applied with declared absence of the mother’s husband if the child was born after the expiry of three hundred days as of the date of the last notice of the husband. It is possible that the court decision, whereby the absence has been announced, may be repealed or amended, which would lead to different consequences concerning the descent from the father.
