Principle of specialty limiting the right in registration of an industrial design

Abstract

The subject matter of the article is the principle of specialty which, in the Polish legal system, limits the scope of protection of the industrial design. In fact, the scope of protection of the industrial design in the Polish law is much narrower than the protection under provisions of the Directive 98/71. In consequence, an increasing number of Polish applications in OHIM results from the principle of specialty and higher charges related to the protection of the industrial design
