Abstract
Досліджено проблеми захисту прав учасників публічних закупівель на різних етапах проведення тендерів зі здійсненням юридичної кваліфікації діянь та проаналізовано судову практику. Визначено «слабкі місця» закону, на підставі яких замовники та учасники можуть зловживати своїми правами, з метою їх усунення розроблено пропозиції до законодавства
