PROBLEMS OF DEFINITION OF THE INDIGENOUS STATUS IN UKRAINE

Abstract
The article is devoted to the description of the concept of "indigenous people" and legally relevant criteria for the recognition of ethnic origin on the basis of an analysis of the norms of international and national legislation. The issue of difference between the concepts "indigenous people" and "national minority" is investigated. The reasons for expanding the rights of indigenous peoples are determined. The comprehensive description of the right to self-determination, as one of the indispensable for the indigenous people, is given. The obligation to apply the principle of non-discrimination in the exercise of indigenous people`s rights is determined on the basis of international law.
