Abstract
This article describes the current situation and problems of surrogacy and use of assisted reproductive methods and technologies in Republic of Kazakhstan and Russian Federation. Defining the differences and similarities of the legal regulation of surrogacy, all the common solutions has been offered.Including the Code of the Republic of Kazakhstan "On Marriage (Matrimony) and Family", the Code of the Republic of Kazakhstan "On the health of the people and the health care system", "Family Code of the Russian Federation"and the federal law "On the fundamentals of protecting the health of citizens in the Russian Federation".
