PROBLEMS ON PROVIDING LEGAL FRAMEWORK FOR THE RELATIONS ASSOCIATED WITH THE TURNOVER OF TECHNOLOGIES IN UKRAINE AND ECONOMIC AND LEGAL PROBLEM SOLVING TECHNIQUES

Abstract

Problem setting: It is common knowledge that the national economy of Ukraine requires qualitative technological upgrade. This process is longstanding and requires a significant concentration of efforts of public authorities, self-governing authorities and business entities. By the same token, the legal science is entrusted by this process with number of requirements for the formation of appropriate adequate legal regulation, which would meet all modern requirements concerning supporting the safety of rights and legitimate interests, the creation of guarantees that are put forward by the developers, authors, users and owners of proprietary rights to technology as an object of legal regulation. Analysis of recent researches and publications: in the course of the research works of such scientists as J. Iu. Atamanova. O. D. Sviatotskyi, P. P. Krainov, S. F. Revutskyi, P. Iu. Poguliaiev were used. Article’s main body: The problems connected with regulatory relations related to the turnover of technologies cover various areas of its functioning and are so common, that first of all require separate research on their identification and systematization. This kind of research should be the basis for further research aimed at developing a system of legal problem solving techniques. By implementation of the specified direction of improving the legal regulation of relations, that mediate the turnover of technologies in Ukraine, in our opinion it is reasonable to offer distinct systematization of problematics concerning economic and legal aspects of the use of technology in the national economy of Ukraine. Conclusions and prospects for the development: All the problems of technology use in the national economy of Ukraine can be systematized into six levels: (1) methodological; (2) institutional; (3) law enforcement; (4) legal; (5) infrastructural; (6) investment. The proposed classification can be used as a basis for further scientific research to determine specific aspects connected with the criticalness of the impact of these shortcomings on the relations associated with the turnover of technologies and can be put by the public administration as the basis of development of special programs concerning state support for the development of high technology in the territory of our state. The author proposes a number of economic and legal measures, the implementation of which will let correction of some shortcomings in the technology transfer sphere, the main number of which is aimed at improving the current legislation of Ukraine. Thus, among the main means we would like to highlight such as (1) the establishment of a unified approach in the normative definition of technology as an object of legal regulation and turnover; (2) fixation of the legal possibility of technology functioning in the form of its material embodiment (equipment, mechanisms, machines, mechanical facilities) and of information embodiment (a set of necessary information (documents), through which the business entity has the ability to reproduce such technology in its own production process); (3) the establishment of public-legal mechanisms of protection of the rights and legitimate interests of participants in relations in the field of technology turnover (independent scientific expertise, establishment of rules, terms and procedure for the protection of rights similar to intellectual property rights); (4) the establishment by the state of institutional entities and associations, aimed at the dissemination of relations connected with the circulation of technologies (technology markets, technopolises, technology transfer networks, etc.); (5) ensuring the process of attracting investment and financial support for technology transfer participants; (6) the adoption of a separate legal act at the level of the Law of Ukraine, which would regulate the technology transfer relations and would fix all these means of overcoming the existing technology market opportunities in Ukraine.
