PROCEDURAL STATUS OF THIRD PARTIES ON THE PROPERTY OF ARREST PROBLEMS IN THE CRIMINAL PROCEEDINGS: THEORETICAL AND LEGAL ASPECTS

Abstract
The article is devoted to the research of the procedural status of a third person, in relation to the property of which the issue of arrest is solved. On the basis of the analysis of scientific literature, the provisions of the legislation and judicial practice, an attempt has been made to determine the individual elements of the legal status of a third person, concerning the property of which the issue of arrest and their content filling is resolved. Separately, attention is drawn to the problematic issues that arise in connection with the acquisition and sale of the legal status of a third person, in respect of whose property the issue of arrest is decided.
